This Website is only intended for use by people resident in the UK. Delivery of products ordered from this Website is only available to the UK mainland. Focus does not accept orders through the Website from individuals outside the UK.
2. Application
By placing an order for a product from this Website you warrant that you:
(a) are legally capable of entering into binding contracts;
(b) are at least 18 years old;
(c) are resident in the United Kingdom;
(d) are accessing the Website from the United Kingdom; and
(e) accept these terms and conditions, and that they shall be incorporated in every contract for the purchase of products from the Website. After placing an order through the Website you will receive an email from Us acknowledging that We have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to Us to buy a product. All orders are subject to acceptance by Us and we reserve the right to decline to sell products.
We will confirm acceptance of your order by sending you an order preparation confirmation by email ("Order Preparation Confirmation"). The contract between you and Us will only be formed when we send you the Order Preparation Confirmation ("Contract").
The Contract will relate only to products whose dispatch we have confirmed in the Order Preparation Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Order Preparation Confirmation.

All products and services contained on or referred to in this Website (including Content that can be downloaded) are subject to availability and Focus has the right to withdraw any product or service at any time without notice. Focus cannot guarantee that the appearance and/or colours of the products shown on this Website exactly reproduce the appearance and/or colours of the physical products themselves.
5. Prices and payment
Payment for all products must be by credit or debit card. We accept payment with all Visa and Mastercard branded cards issued by UK banks plus American Express We will not charge your credit or debit card until we despatch your order.
All prices for products will be as displayed on this Website from time to time except in the case of obvious error and are inclusive of VAT. Delivery will be charged in addition. Such delivery charges and any additional charges are clearly displayed where they apply. Click here for standard delivery details. If they do then in the event of any inconsistency the Special Terms and Conditions of Sale will prevail over the standard delivery provisions referred to above.
Prices of products are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Preparation Confirmation.
Our Website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on the Website may be incorrectly priced. We will normally verify prices as part of our dispatch procedures prior to acceptance of an order so that, where a product's correct price is less than our stated price. We will charge the lower amount when dispatching the product to you. If a product's correct price is higher than the price stated on our Website We may at our discretion either reject your order without liability to you and notify you of such rejection or contact you for instructions before dispatching the product.
We are under no obligation to supply products to you at an incorrect (lower) price, even after we have sent you an Order Preparation Confirmation, if the pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mis-pricing.
From time to time, the prices for products displayed on this Website may differ from the prices payable for the same products in Focus stores. If a lower price is displayed on this Website than is displayed for the same product at a Focus store, We are under no obligation to honour that lower price in any Focus store. If a lower price is displayed in a Focus store than is displayed for the same product on this Website, We are under no obligation to honour that lower price on this Website.
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when We receive full payment of all sums due in respect of the products, including delivery charges.
6. Availability and delivery
Your order will be fulfilled within 30 days of the date we received your order, unless there are exceptional circumstances.
All delivery times apply to products that are in stock.
Unfortunately we are unable to specify the exact time of delivery.
Unless otherwise stated, all deliveries will be made direct to your door. We are not responsible for additional lifting or carrying of the products.
We de not deliver items to multiple addresses.
We regret that we are able to deliver to the UK mainland only and not to Northern Ireland, Scottish Islands, Isle of Scilly, Isle of Man, Isle Of Wight, Jersey, Guernsey and BFPO addresses.
Not all stores stock every item, please check before you travel. Offers are not available in stock liquidation and store closing stores. Some offers may not apply at focusdiy.co.uk.
We endeavour to supply products which meet our customers' expectation. We recommend to our customers that they should confirm before any tradesman or fitter has been arranged that the goods ordered have been received complete and in good condition.
7. your right to cancel
Unless the products are subject to Special Terms and Conditions of Sale containing provisions to the contrary in relation to those products you may cancel your order at any stage in accordance with this condition 7 before, and up to 30 days after, the products are delivered to you and in any event if you are contracting as a consumer, you may cancel your order at any time within seven Working Days, beginning on the day after you received the products
To cancel your order before delivery, you must notify our customer services department in writing or by email at our registered office or email address given in condition 12 below. To cancel your order after delivery you must notify our internet department at our distribution centre on the telephone number given in condition 12. You must as soon as reasonably practicable return the products We have delivered to you (together with the sales invoice for those products) at your own cost and risk to any Focus store, return them to our internet department at the address given in condition 12 quoting the cancellation number given to you when you called our internet department on the outside of the package or contact us to arrange for collection of the products. If you are returning products to a Focus store you should inform the store staff that you ordered the products via the Website and give to them the cancellation number given to you by our internet department.
We aim to process your order for despatch to you within three to five Working Days of receiving it. Consequently, even if you do cancel your order shortly after placing it, it is possible that We may be unable to prevent products you have ordered being despatched to you and you may then need to return them to Us.
Products must be returned or made available for collection preferably within their original packaging. If you are contracting as a consumer and you cancel your order within seven Working Days (beginning on the day alter you received the products) We will refund you the amount paid for the products including the delivery charges. However you will be responsible for the cost of returning-them to us. The cost of the return delivery will be deducted from the amount credited back to your credit card following receipt of the cancelled order at our distribution centre. If you are not contracting as a consumer or if you are contracting as a consumer but cancel your order after seven Working Days (beginning an the day after you received the products) but before expiry of 30 days after the products are delivered to you, unless condition 8 applies, We will refund you the amount paid for the products only and not the delivery charges paid by you and you will be responsible for the cost of returning the products to us. The cost of both the delivery and collection of the order will be deducted from the amount credited back to your credit card following receipt of the cancelled order at our Distribution Centre.
Unless condition 8 applies it you wish Us to arrange for the collection of the products you will be liable for the cost of such collection. Details of such costs are available on request. Where you return the product to Us you shall be responsible for the cost of such return unless condition 8 applies. This cost will be deducted from the amount to be credited back to your credit card.
This condition 7 is in addition to any statutory rights you may have as a consumer, which remain unaffected.
8. Faulty, incorrect or damaged products
If the products are faulty, incorrect or damaged on delivery, We will (at your option) replace or exchange any such products, or refund to you the price paid including all delivery charges provided that:
(a) you notify us of the fault, mistake or damage within seven days of receipt of product; or
(b) where you can show that it was not reasonably possible to give such notice within the above period, you give notice of the fault, mistake or damage in a period which is reasonable in the circumstances.
Alternatively, where the products have been delivered directly by our supplier, you may contact the supplier in accordance with the above to request repair, replacement or exchange of such products at the supplier's cost.
Faulty, incorrect or damaged products may be returned to Focus at any Focus store. You will be entitled to a refund of the costs incurred in returning the products. Alternatively, Focus can arrange for collection of the products at your request. You will not be required to bear the cost of such collection.
9. Refunds
Refunds for cancellation pursuant to condition 7 above shall be made within 30 days of the date of cancellation. You are reminded of your obligations relating to the return of the products set out in condition 7.
Refunds for faulty, incorrect or damaged products shall be made within 30 days of the date of return of the products.
We will usually refund any money received from you using the same method originally used by you to pay for your purchase.
This condition 9 is in addition to any statutory rights you may have as a consumer, which remain unaffected.
10. Limitations of Liability

Our total liability for losses you suffer as a result of Us breaking the terms of the Contract (in respect of each event or series of connected events) is strictly limited to the net purchase price of the product you purchased and any losses which are a foreseeable consequence of Us breaking the Contract. Losses are foreseeable where they could be contemplated by you and Us at the time your order is accepted by Us.
We do not exclude or limit in anyway liability,
(a) for death or personal injury arising from our negligence;
(b) for fraud or fraudulent misrepresentation;
(c) under section 2(3) of the Consumer Protection Act 1987;
(d) for any matter for which it would be illegal for Us to exclude or attempt to exclude our liability; or
(e) for any deliberate breaches of the Contract by Us that would entitle you to terminate the Contract between Us.
We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and Us, including but not limited to:
(a) loss of income or revenue;
(b) loss of business;
(c) loss of profits or contracts;
(d) loss of anticipated savings;
(e) loss of data; or
(f) waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise,
provided that this paragraph shall not prevent claims for loss of or damage to your tangible property that fall within any of the preceding terms of this condition 10, or any other claims for direct financial loss that are not excluded by any of categories (a) to (f) inclusive of this condition 10.
11. General
We strongly recommend that any manuals and safety instructions provided with tools, products or materials used in carrying out any DIY project should be read and carefully followed at all times.
We shall not be liable to you where performance of any of our obligations to you is prevented, frustrated or impeded by any circumstance or cause beyond our reasonable control which shall include, but not be limited to, acts of God, strikes or any other industrial action, war, civil commotion, acts of government or any change in statute, order or regulation having the force of law that affects our operation or affairs. If any such circumstances occur We will discharge our obligations as soon as practicable after such circumstances have ceased to affect our operations.
Headings in these conditions are for convenience only and shall not affect its interpretation or construction.
A person who is not a party to any Contract entered into by Us has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of such Contract but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
You may not transfer, assign, charge or otherwise dispose of a Contract for the purchase of products or any of your rights or obligations arising under it without our prior written consent.
We may transfer, assign: charge, sub-contract or otherwise dispose of a Contract for the sale to you of products or obligations arising under it, at any time during the term of the Contract.
The invalidity, illegality or unenforceability of the whole or part of a term, or condition of these terms and conditions does not affect or impair the continuation in force of the remainder of these terms and conditions.
If We fail at any time during the term of a Contract for the sale to you of products to insist on strict performance of any of your obligations under such Contract or any of these terms and Conditions of the Special Terms and Conditions of Sale, or if We fail to exercise any of the rights or remedies to which We are entitled under the Contract, this shall not constitute a waiver of such rights or remedies to which We are entitled under such Contract and shall not relieve you from compliance with such obligations. Focus does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use www.focusdiy.co.uk only with the involvement of a parent or guardian.
How do I make a complaint to Focus?

Conditions of use for Summer Discount Card.
The Summer Discount card entitles the authorised signatory to a discount of 10% on all purchases every day. *Excludes lawnmowers, gift vouchers, goods from in store concessions and other such products as may be specified from time to time. The card cannot be used in conjunction with any other discount card or money off voucher or major discount promotions as specified. Offer ends 30th August 2010. The card must be presented at the time of purchase and is not transferable. It is not a credit card or cheque guarantee card. The card remains the property of Focus (DIY) Ltd, who reserve the right to change the conditions of use or withdraw the card without prior notice.
